to JD Vance or what ever his real name is!

Today I searched the internet news to find a clear Blithering Ninny winner.  Today’s winner by far is JD Vance, the 40-year-old Vice President.  Here is is his winning remark.  “Judges aren’t allowed to control the executive branch’s legitimate power”.  Over the weekend, Vice President JD Vance delivered this warning shot to the federal judiciary.  Yea, OK, you did go to law school JD?  Maybe you skipped a few classes or forgot a bunch while working for a billionaire.  There is that discussion about checks and balances.

How about what the constitution says about this.   The Constitution does give the federal courts the judicial power, which states “people have to abide by their orders”. Federal judges can give increasingly intense, enthusiastic orders to be followed.  The really important thing is that presidents have complied with federal court orders in the past.  A bit of history there folks!

This post concerns Dr. Smith’s Blithering Ninny Award. Dr. Smith use to call the Robot a Blithering Ninny along with other names.  Moving on to what the Constitution has written.

Article III Section 2 (Just the facts)

The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;  Sort of the rule on how to act.  Even Tricky Dicky toed the line.

Here are the other facts:

  1. JD Vance wrote this comment on social media platform I don’t talk about and have never been on not will mention in my blog posts.
  2. A famous cases in the past where the Executive branch had to turn over the tapes in the Watergate case due to Judaical order.  Opps, Nixon resigned.
  3. I am not the only one to notice and comment on this blunder.
  4. Typical coup misinformation by an authoritarian leader
  5. Sorry, I don’t like folks that spit on our history and traditions.

My opinion – JD Vance has a bad history of saying dumb things that show he missed more than a few classes at Yale Law School.  We will see more junk in his trunk soon.  Bet your bibby we will see more whining in the coming months and more trash talk

Threats to the Separation of Powers – a bit of history

One significant contemporary threat to the separation of powers is executive overreach, exemplified by the growth of the administrative state. Executive agencies have accumulated powers that traditionally belong to the legislative and judicial branches.  The Executive’s branches tendency to address major questions of economic and political significance without clear congressional authorization is increasingly prevalent. The Major Questions Doctrine, recently revitalized by the Supreme Court, maintains that issues of substantial importance must be clearly sanctioned by Congress.  This concerns executive orders by the way.
